OVERVIEW

Welcome to GrandeurVibe.

Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to GrandeurVibe. GrandeurVibe operates this online store and website, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”).

Our online store is hosted and supported by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”), together with any policies referenced in them, explain the rights and responsibilities that apply when you access, browse, interact with, or purchase from GrandeurVibe.

Please read these Terms carefully before accessing or using our Services. They contain important information concerning your legal rights, obligations, warranties, limitations of liability, and dispute-related provisions.

By accessing or using any part of our Services or placing an order through our store, you agree to these Terms and our Privacy Policy.

If you do not agree with these Terms or our Privacy Policy, you should not access or use the Services.

Nothing in these Terms is intended to exclude, restrict, or limit any consumer rights that cannot legally be excluded under applicable law.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are at least the age of legal majority in your country, state, province, or jurisdiction of residence, or that you have obtained any consent required for a minor under your responsibility to use the Services.

When browsing our store, creating an account, placing an order, or otherwise using the Services, you may be required to provide information including your name, email address, billing details, payment information, shipping address, and other information required to complete your transaction.

You agree that all information you provide to us is accurate, current, complete, and lawfully provided.

You are responsible for protecting the confidentiality of any account credentials associated with your account and for activities performed through your account.

We make reasonable efforts to display and describe our products as accurately as possible.

However, the appearance of colors, finishes, brightness, materials, textures, dimensions, or other visual characteristics may vary slightly depending on your monitor, mobile device, display settings, lighting conditions, photography, or other technical factors.

Minor variations resulting from manufacturing methods, materials, or handcrafted production may occur where applicable and do not necessarily constitute a defect.

Product photographs and videos are intended to provide an accurate representation of the item but may not perfectly reproduce how the product appears under every real-world condition.

Product descriptions, specifications, availability, designs, features, packaging, and other information may be updated where reasonably necessary.

We reserve the right to discontinue products or limit product quantities available for purchase, subject to applicable law.

Where a product is subject to specific safety, installation, electrical, usage, or maintenance instructions, customers are responsible for following those instructions.

Nothing in this section limits any statutory rights relating to products that are faulty, unsafe, damaged, or materially different from their description.

SECTION 3 – ORDERS

Submitting an order through GrandeurVibe constitutes an offer by you to purchase the products included in your order.

Receiving an automated order confirmation does not necessarily mean that we have accepted your order.

We reserve the right, where permitted by law, to accept, reject, cancel, or limit an order for legitimate reasons, including but not limited to:

  • product unavailability;

  • incorrect pricing or product information;

  • suspected fraud or unauthorized payment activity;

  • payment authorization failure;

  • shipping restrictions;

  • unusually large quantities;

  • suspected resale activity;

  • technical or inventory errors; or

  • legal or regulatory restrictions.

An order is considered accepted when payment has been successfully authorized or processed and we confirm that the order is being processed or fulfilled.

Please review all order information carefully before submitting your order, including product selection, quantity, variant, delivery address, and contact details.

If you need to modify or cancel an order, contact us as quickly as possible at info@grandeurvibe.com.

We cannot guarantee that an order can be modified or cancelled after fulfillment or production has begun.

If we cancel an order after payment has been received, any applicable amount paid for the cancelled item or order will be refunded to the original payment method.

Returns, exchanges, cancellations, and refunds are also subject to our Refund Policy and any mandatory rights provided by applicable consumer law.

Products purchased from GrandeurVibe are intended primarily for personal or household use unless otherwise agreed in writing.

SECTION 4 – PRICES AND BILLING

Product prices, discounts, promotions, and special offers displayed on the Services may change from time to time.

Except in cases of obvious error or where otherwise required by law, the price applicable to your purchase will be the price presented during checkout when your order is placed.

Applicable shipping charges, taxes, duties, customs fees, import charges, or other charges will be displayed or communicated where required and where reasonably possible before the order is completed.

Whether duties, taxes, or import charges are included in the purchase price depends on the destination, shipping method, applicable local rules, and the terms displayed during checkout.

Promotional offers may have separate eligibility conditions, time limits, quantity restrictions, discount rules, or other conditions.

If specific promotional terms conflict with these Terms in relation to that promotion, the specific promotional terms will apply.

You agree to provide accurate and complete billing and payment information.

You represent that you are authorized to use the payment method submitted with your purchase.

You agree to promptly update your contact and payment information where necessary so that we can complete transactions and communicate with you regarding your order.

Payments may be processed by third-party payment providers. Your use of those payment services may also be subject to the terms and privacy practices of the applicable provider.

SECTION 5 – SHIPPING AND DELIVERY

Delivery dates and transit times displayed by GrandeurVibe are estimates unless expressly stated otherwise.

We make reasonable efforts to dispatch and deliver orders within the estimated timeframe provided to you.

Actual delivery times may be affected by circumstances including:

  • carrier delays;

  • customs inspections or clearance procedures;

  • weather;

  • public holidays;

  • incorrect or incomplete delivery information;

  • destination-country procedures;

  • local delivery restrictions;

  • logistical disruptions; or

  • events beyond our reasonable control.

We are not responsible for delays caused solely by circumstances outside our reasonable control where permitted by applicable law.

However, nothing in this section removes any mandatory delivery rights available to consumers under applicable law.

Where GrandeurVibe or a shipping provider selected by us arranges delivery to a consumer, responsibility for loss or damage during transportation will remain allocated in accordance with applicable consumer law.

Where mandatory law provides that risk remains with the seller until the customer receives physical possession of the goods, these Terms do not override that protection.

Customers are responsible for providing an accurate and complete delivery address.

Additional costs resulting directly from an incorrect address provided by the customer may, where legally permitted, be charged to the customer.

International shipments may be subject to customs procedures and import regulations imposed by the destination country.

SECTION 6 – INTELLECTUAL PROPERTY

Unless otherwise stated, the GrandeurVibe Services and the original content created for them, including website designs, layouts, text, graphics, photographs, videos, product photography, logos, icons, software elements, branding, and other materials, are owned by or licensed to GrandeurVibe and are protected by applicable intellectual-property laws.

Third-party trademarks, trade names, logos, artwork, designs, and other intellectual property appearing on the Services remain the property of their respective owners.

No appearance of third-party intellectual property on our Services should be interpreted as granting ownership of that intellectual property to GrandeurVibe.

You may access the Services for lawful personal and non-commercial purposes.

Except where permitted by law or expressly authorized by us, you may not:

  • reproduce;

  • copy;

  • republish;

  • commercially exploit;

  • distribute;

  • scrape;

  • modify;

  • reverse engineer;

  • create derivative works from;

  • publicly display; or

  • systematically download

our protected website materials.

Nothing in these Terms grants you ownership of, or a license to, GrandeurVibe intellectual property except for the limited right to access the Services in accordance with these Terms.

Shopify names, trademarks, logos, products, and related materials belong to Shopify or its licensors.

All other third-party intellectual property belongs to its respective owner.

SECTION 7 – OPTIONAL TOOLS

The Services may provide access to third-party applications, tools, integrations, widgets, payment systems, tracking services, review platforms, or other technologies.

These services may be operated independently from GrandeurVibe.

Unless expressly stated otherwise, we do not control the operation, availability, content, policies, or functionality of third-party tools.

Third-party tools may be made available on an “as available” basis and may be subject to separate terms and privacy policies imposed by their providers.

Your decision to use a third-party tool is voluntary and may be subject to those third-party terms.

To the extent permitted by law, GrandeurVibe will not be responsible for losses arising solely from the independent operation of third-party services that are outside our reasonable control.

We may introduce new tools, resources, functions, applications, or features in the future. Unless stated otherwise, those additions will form part of the Services and will be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to websites, platforms, services, applications, or content provided by third parties.

A link does not necessarily mean that GrandeurVibe endorses, controls, sponsors, or guarantees that third party.

We are not responsible for independently verifying all information, products, services, security practices, terms, or privacy policies provided by third-party websites.

If you leave our Services and access a third-party service, you do so subject to the applicable third party's terms and policies.

Any dispute concerning a purchase made directly from an independent third party should generally be addressed to that third party.

Nothing in this section affects rights you may have where GrandeurVibe is legally responsible for a third-party provider acting on our behalf.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

GrandeurVibe uses Shopify technology to operate and provide its ecommerce Services.

Shopify provides the ecommerce infrastructure that enables the GrandeurVibe online store to function.

However, purchases made from GrandeurVibe are transactions between you and GrandeurVibe, not between you and Shopify.

GrandeurVibe is responsible for its products, product descriptions, fulfillment, customer service, refunds, and other obligations relating to sales made through the GrandeurVibe store, subject to applicable law.

Shopify is not the seller of GrandeurVibe products merely because Shopify provides the platform used to operate our store.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims relating solely to products purchased from GrandeurVibe or transactions made directly between GrandeurVibe and its customers.

Nothing in this section limits any rights or remedies that cannot lawfully be excluded.

SECTION 10 – PRIVACY POLICY

Personal information collected through our Services is processed in accordance with our Privacy Policy and applicable data-protection law.

Our store is hosted through Shopify. As part of providing its ecommerce infrastructure and related services, Shopify may collect and process certain information relating to your access to and use of the Services.

Information may also be processed by payment processors, shipping providers, analytics providers, customer-service services, marketing platforms, and other service providers where necessary to operate the Services.

Depending on your location and the service providers involved, personal information may be processed or stored in jurisdictions outside the country where you reside, subject to applicable legal safeguards.

Please review the GrandeurVibe Privacy Policy for further information about how personal information is collected, used, disclosed, stored, and protected.

You should also review Shopify's Privacy Policy where relevant to Shopify's own processing activities.

SECTION 11 – FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily submit reviews, photographs, videos, comments, suggestions, product feedback, testimonials, ideas, or other materials to GrandeurVibe (“User Content”), you retain any ownership rights that you already have in that content.

However, by submitting User Content to us or publicly posting content specifically relating to our products while granting us permission to use it, you grant GrandeurVibe a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, distribute, and use that User Content for legitimate business purposes, including customer support, product improvement, advertising, marketing, and promotion, subject to applicable law.

Where consent is legally required for a particular use, we will obtain the required consent.

You represent that:

  • you own or have permission to submit the User Content;

  • your submission does not violate another person's rights;

  • your submission is not fraudulent or misleading;

  • required sponsorship or incentive disclosures have been made; and

  • your submission does not contain unlawful or malicious material.

We are not obligated to compensate you for unsolicited ideas or suggestions unless otherwise agreed.

We may moderate or remove User Content that violates these Terms, applicable law, third-party rights, or our platform policies.

You may not submit content containing malware, unlawful material, threats, harassment, defamatory statements, fraudulent reviews, impersonation, or content that violates another person's intellectual-property or privacy rights.

You remain responsible for the accuracy and legality of the User Content you submit.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

From time to time, information available through the Services may contain typographical errors, technical errors, inaccuracies, outdated information, or omissions.

These may relate to matters such as:

  • product descriptions;

  • photographs;

  • specifications;

  • inventory;

  • prices;

  • discounts;

  • promotions;

  • shipping costs;

  • estimated transit times; or

  • product availability.

Where legally permitted, we reserve the right to correct such information when an error is discovered.

If an obvious pricing or product-information error affects an order, we may contact you to provide the correct information and give you an appropriate option to proceed or cancel, as required by applicable law.

Nothing in this section permits GrandeurVibe to retroactively alter a concluded consumer contract where applicable law prohibits doing so.

SECTION 13 – PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use or attempt to use the Services:

  • for unlawful, fraudulent, or malicious purposes;

  • to violate applicable local, national, international, federal, state, provincial, or regional laws;

  • to infringe intellectual-property rights;

  • to violate privacy or data-protection rights;

  • to harass, threaten, abuse, defame, intimidate, or unlawfully discriminate against another person;

  • to submit materially false or misleading information;

  • to impersonate another individual or organization;

  • to distribute spam, phishing messages, chain letters, unsolicited advertising, or other abusive communications;

  • to upload malware, viruses, malicious scripts, or harmful code;

  • to compromise or attempt to compromise website security;

  • to gain unauthorized access to an account, server, system, database, or network;

  • to interfere with the proper operation of our Services; or

  • to use the Services in a manner that causes unlawful harm to GrandeurVibe, Shopify, our customers, or third parties.

You must also not systematically extract, scrape, harvest, collect, reproduce, or commercially exploit data or content from the Services without authorization where such activity is prohibited by law or by these Terms.

We may suspend or restrict access to the Services where we reasonably believe these Terms have been materially violated.

SECTION 14 – AUTOMATED AGENTS AND SYSTEMS

This section applies where automated or semi-automated software, bots, artificial-intelligence agents, crawlers, scrapers, purchasing agents, or other automated systems (“Agents”) access or interact with the Services.

Agents must comply with applicable law, published technical restrictions, security measures, robots directives where applicable, and these Terms.

Agents must not:

  • misrepresent themselves as a human when identification is reasonably required;

  • circumvent CAPTCHA systems;

  • bypass rate limits;

  • evade access restrictions;

  • defeat anti-bot or fraud-prevention mechanisms;

  • obtain unauthorized access;

  • interfere with site functionality;

  • create abusive or fraudulent purchasing activity; or

  • collect personal information unlawfully.

Where technically required by GrandeurVibe, an Agent must accurately identify its automated nature and must not intentionally conceal its identity for the purpose of circumventing our security systems.

We reserve the right to limit or block automated access where reasonably necessary to protect the Services, customers, infrastructure, security, inventory, or fraud-prevention systems.

SECTION 15 – TERMINATION

You may stop using the Services at any time.

We may suspend, restrict, or terminate your access to some or all of the Services where reasonably necessary, including where:

  • you materially violate these Terms;

  • fraudulent activity is suspected;

  • security threats are detected;

  • unlawful use occurs; or

  • continued access would create material risk to us, our customers, Shopify, or third parties.

Where legally required, appropriate notice will be provided.

Termination does not eliminate payment obligations or other liabilities that arose before termination.

Provisions that by their nature should remain effective following termination will continue to apply.

These may include provisions concerning intellectual property, User Content, payment obligations, limitation of liability, indemnification, governing law, privacy, severability, and dispute-related matters.

SECTION 16 – DISCLAIMER OF WARRANTIES

We make reasonable efforts to maintain the accuracy, security, and availability of our Services.

However, internet-based services may occasionally be interrupted, unavailable, delayed, or affected by circumstances outside our control.

To the fullest extent permitted by applicable law, the website and Services are provided on an “as available” basis.

We do not guarantee that access to the website will always be uninterrupted, completely secure, error-free, or free from technical defects.

General informational content provided through the Services is not professional, legal, medical, financial, or technical advice unless expressly stated otherwise.

Any warranty exclusions contained in these Terms apply only to the extent legally permitted.

Nothing in these Terms excludes or limits statutory warranties, guarantees, conformity obligations, or other consumer protections that cannot legally be excluded.

In particular, nothing in these Terms is intended to remove legal remedies available to a consumer for goods that are faulty, unsafe, not as described, or otherwise non-conforming under applicable law.

SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, GrandeurVibe and its affiliates, directors, officers, employees, contractors, service providers, and agents will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the Services where such losses were not reasonably foreseeable or where liability may lawfully be excluded.

This may include, where legally permitted, loss of profits, revenue, business opportunity, data, or other economic losses.

However, nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude liability for:

  • fraud or fraudulent misrepresentation;

  • death or personal injury where liability cannot legally be excluded;

  • mandatory product-safety obligations;

  • statutory consumer rights;

  • goods that are legally required to be as described or of satisfactory quality;

  • intentional misconduct; or

  • any other liability that applicable law prohibits us from excluding.

Any limitation of liability involving Shopify or another service provider also applies only to the extent permitted by applicable law.

SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, if your unlawful conduct, intentional misuse of the Services, infringement of third-party rights, or material breach of these Terms causes a third party to make a claim against GrandeurVibe, you agree to indemnify GrandeurVibe for reasonable losses, liabilities, damages, and costs directly resulting from that claim.

This obligation applies only to the extent legally enforceable and proportionate to the conduct giving rise to the claim.

We will provide reasonable notice of an indemnifiable claim where practicable.

You agree to reasonably cooperate with the defense of such a claim.

GrandeurVibe will not use this clause to restrict mandatory consumer rights or impose liability where doing so would be unfair or unlawful under applicable consumer law.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found by a court or competent authority to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, treated as removed from these Terms.

The remaining provisions will continue in effect to the extent permitted by law.

Where possible, an invalid provision will be interpreted or adjusted in a manner that most closely reflects its lawful intended purpose.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

If GrandeurVibe does not immediately exercise or enforce a right available under these Terms, that does not mean that we waive that right.

A waiver concerning one breach or event does not automatically constitute a waiver concerning another breach or event.

These Terms, together with policies and conditions expressly incorporated into them, constitute the agreement governing your use of the Services.

They replace previous versions of these Terms relating to the same subject matter.

Nothing in this clause excludes representations or information that applicable consumer law requires us to honor.

SECTION 21 – ASSIGNMENT

You may not transfer or assign contractual rights or obligations under these Terms where doing so would materially affect GrandeurVibe without our prior written consent, except where applicable law gives you a right to do so.

GrandeurVibe may transfer or assign its rights and obligations as part of a legitimate corporate restructuring, merger, acquisition, sale, financing transaction, or transfer of the business.

Any such transfer will remain subject to applicable law and will not reduce mandatory consumer protections.

Where legally required, customers will be notified of a transfer that materially affects their rights.

SECTION 22 – GOVERNING LAW

These Terms and any separate agreements relating to the Services will be governed by the laws applicable to the jurisdiction in which the business operating GrandeurVibe is legally established, subject to mandatory consumer-protection rules.

Nothing in this section deprives a consumer of mandatory protections granted by the laws of the country in which that consumer habitually resides where those protections legally apply.

Any court, tribunal, arbitration body, consumer-protection authority, or other dispute-resolution mechanism having mandatory jurisdiction under applicable law will retain that jurisdiction.

Where permitted by applicable law, disputes may otherwise be brought before the competent courts having jurisdiction over the business operating GrandeurVibe.

Section titles and headings are included for convenience and readability only.

They do not change, restrict, or expand the meaning of the substantive provisions of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

The most current version of these Terms of Service will be made available through our website.

We may revise these Terms when reasonably necessary, including to reflect:

  • changes to our Services;

  • changes to our business operations;

  • new features or technologies;

  • legal or regulatory requirements;

  • security requirements; or

  • changes to third-party services used by our store.

Where required by applicable law, we will provide notice of material changes.

Changes will become effective on the date indicated in the updated Terms or in the notice provided.

Changes will not retroactively remove rights that have already arisen under an existing consumer transaction unless applicable law permits that result.
